Privacy Policy

1. General provisions

1.1. This Privacy Policy (hereinafter - the "Policy") was developed by "FS PRO" LLC (EDRPOU code: 43 053 417, address: 8 136, Kyiv region, Buchanskyi district, Kryukivshchyna village, Balukova street, 1A, hereinafter - "Company " and/or "Site Administration") in accordance with the current legislation of Ukraine, including, but not limited to, the Law of Ukraine "On the Protection of Personal Data" dated June 01, 2010 No. 2297-VI, taking into account the principles and rules of the General Data Protection Regulation Regulation (GDPR) of the European Union regarding Users of the fspro.ua Site and establishes the procedure for receiving, collecting, accumulating, storing, processing, using, ensuring protection and disclosure of personal data (hereinafter - "Data") with the help of the Site and/or related to services and tools.

1.2. Data means any information directly or indirectly related to a specific User. This can be: first name, last name, patronymic (if available), information about the type of activity, marital status, education, e-mail address, phone number, region of residence, address of the place of residence/stay, information about the User's actions on Sites, IP address, device data (computer, browser type, mobile device operating system) used by the User, messages (information contained in correspondence between Users, as well as in correspondence with the Site Administration), other information, with the help of which communication is carried out, which at the User's request is provided by him when placing an order on the Site, when completing a survey (by filling out a questionnaire or in another way), writing a message or feedback, or information received during oral communication between the User and the Site Administration, information that is provided upon payment and/or use by the User of any service (service) provided by the Company.

1.3. Data processing means any action with Data, including, but not limited to: access, provision, distribution, collection, systematization, storage, accumulation, recording, transmission, blocking, deletion, clarification, updating and/or modification, depersonalization and other ways of using Data by the Company.

1.4. Users can provide Data independently by posting such data on the Site or by communicating via telephone channels and/or to the Company's email and/or postal address, by filling out questionnaires (filling in a questionnaire or in another way), or Data can be provided from other sources (in accordance with Clause 3 of this Policy) for example, from the feedback of Users (rating, comments, confirmation of information) or other information from third parties provided in the course of sending claims, complaints and/or when considering disputes, and/or information from publicly known sources on the Internet.

1.5. The user has no right to use the fspro.ua Site if he does not agree with the terms of this Policy.

1.6. The User acknowledges that in the event of his careless attitude to the security and protection of his Data and authorization data (password, login), third parties may gain unauthorized access to the User's account and Data. The Company shall not be liable for any damages caused by such Access.

2. What Data may be collected

2.1. The Company may collect the following Data:

  • first name, last name, patronymic (if available), passport data, registration number of the taxpayer registration card, date of birth and/or age, gender, marital status, details of the authorized person of the company, company name, company details, contact numbers , e-mail address, company location address, other contacts given at the User's request (for example, place and/or work address);
  • information about the User's account (in particular, login, phone number), e-mail address, login and password, account processing data, other Data necessary for providing services to Site Users, communication with Users, including in the process of contacting the User to the support service Site;
  • information that Users provide to the Company when concluding contracts for the provision of services by accepting a public offer posted on the Site;
  • information that is necessary for communication between Site Users, including for the execution and confirmation of agreements between the seller and buyers, receiving and sending messages, posting reviews, comments, making payments, for fulfilling requests from Users and receiving feedback from the User when necessary, information posted by Users based on the results of their service, reviews, comments, appeals to the customer support service, complaints, claims, other appeals;
  • data about devices used by Users, information about Users' websites, such as: IP address; the date and time when the User uses the Site, information about the software, as well as the Internet browser used by the User, information about the operating system of the mobile device, information about the operation of the User's devices, individual identifiers of the devices used by the Users;
  • data obtained as a result of conducting various surveys by the Company and/or third parties authorized by the Company, with the aim of improving the provision of services to Users; information received by the Company as a result of marketing activities;
  • information about the User's actions on the Site (consumer behavior regarding purchased goods, works, services on the Site) information about communication with other Users, including information left by Users in the form of reviews, ratings, comments or any other feedback from Users; information in accordance with which User ratings are formed, which contains user experience and which Users leave on the site as a result of interaction with other Users, which allows the Company to take the necessary measures with the aim of maintaining quality service and avoiding fraudulent actions:
  • information posted or provided to Users in the process of their participation in bonus programs, quizzes, promotions, special offers that take place on the Site organized by the Company;
  • information received from Users by filling out questionnaires or communicated in another way to the Site Administration (this can be information including but not limited to: citizenship, place of birth, education, profession, specialization, work experience, social status, family composition (surnames , name, patronymic of such persons, their gender, age, place of registration and residence, contact data), photo, video image of the User (and/or authorized person of the User, etc.);
  • information received by the Company in a legal manner from partners and/or third parties.

2.2. The Company may also process Data using the following technologies:

  • Cookies files (cookies are small pieces of data that are sent to the User's computer when visiting a web page and/or when viewing an advertising module on a web page and are stored on the User's computer and/or in his mobile device);
  • pixels (pixels are digital images, an element of the matrix of displays that form an image), which allow tracking the frequency of the User's use of the web page with the purpose of identifying the User's browser and providing the service, for example, storing Data in the basket between visits; and also for the purpose of eliminating errors of the Site, initiated by the User, while all information is processed "as is" and is not changed in the process of Data collection.

3. Use, sharing and purposes of Data processing

3.1. The Company uses and processes Data for the following purposes:

  • implementation of the functions, powers and obligations assigned to the Company in accordance with the current legislation of Ukraine, as well as ensuring the implementation of civil, economic and tax relations;
  • for identification of the client as a Site User, for communication with the User, including for the provision of services, sending, settlement operations, reporting, accounting and management accounting, creation and implementation of bonus programs, loyalty programs, sending mailings by mail, e-mail , by phone number, including for the purpose of sending commercial offers, notifications about promotions and fspro.ua news, as well as other portals/sites at the disposal and/or owned by FS PRO LLC, and/or to notify Users The website about financial services provided by third parties and/or partners of "FS PRO" LLC, with the aim of improving the quality of service provision, formation of ratings, analysis of User activity, search by keywords, management of traffic on the Site, analysis and forecasting of preferences, interests Users; conducting research and analytical activities, as well as ensuring compliance by Users of the terms of the User Agreement, the Rules for posting information on the Site, the Rules for the publication of reviews, the Rules for the design of product items, the Rules for posting advertisements;
  • with the purpose of sending newsletters, commercial offers, notifications about promotions, loyalty programs, bonus programs and/or with the purpose of sending messages regarding the functioning of the fspro.ua Site and/or other portals/sites that are at the disposal and/or owned by FS PRO LLC » by mail, e-mail;
  • with the purpose of ensuring the Company's provision of Internet services to the Site, information exchange;
  • with the purpose of displaying the Data specified by Buyers in their Personal accounts on the fspro.ua Website, created on the basis of the fspro.ua Website.
  • The Company may exchange Data with the Company's affiliates (companies operating under common ownership), who may process and use the Data for the purpose specified in Section 3 of this Policy.

3.2. The company does not process data related to race, nationality, political views, religious and other beliefs, membership in public organizations. Information that characterizes the physiological characteristics of Users, on the basis of which it is possible to establish their identity, is also not processed.

3.3. Data processing and storage terms are determined based on the purposes of Data processing, as well as based on the conditions specified in the contracts concluded with Users in accordance with the requirements of the current legislation of Ukraine

4. Conditions for providing access to Data

4.1. Disclosure of Data occurs when the User orders goods/services on fspro.ua from the seller/supplier of such goods and services, but only to the extent necessary to identify the User and his order.

4.2. In some cases, with the aim of demonstrating the effectiveness of the Site and improving the Site's image, the Company may disclose the statistics of the Users' sites without disclosing personal data and information that is a commercial secret.

4.3. The Site contains links to other web resources to which this Policy does not apply.

4.4. The Company processes Data on a legal and fair basis: Data is not disclosed to third parties and is not distributed without the User's consent, with the exception of cases provided for by the current legislation of Ukraine and only in the interests of national security, economic well-being and human rights, in particular, but not exclusively:

  • upon justified requests of public authorities that have the right to request and receive such Data;
  • in the event that "FS PRO" LLC has reasonable suspicions about the User's violation of the terms of this Policy and/or other contracts and agreements concluded between "FS PRO" LLC and the User, as well as the provisions of the User Agreement, the Rules for posting information on the Site, the Rules for publishing reviews , Rules for the registration of product positions, Rules for placing ads.

4.5. The Company reserves the right, in accordance with the requirements of the current legislation of Ukraine, to exchange Data with state authorities for the purpose of: preventing fraud on the Site; settlement of disputed situations and clarification of circumstances that are/may be the cause of violation of current legislation, as well as in the event that the Company detects illegal actions of Site Users and/or receives claims, complaints, appeals from third parties.

5. How to change/delete Data or withdraw consent

5.1. Users can at any time change/delete personal information or refuse to receive messages, or withdraw consent to Data processing through their Personal account or by sending a message to the email address: info@fspro.ua or the postal address: 8 136, Kyivska region, village Kryukivshchyna, str. Balukova, 1 A, A/S 33.

5.2. After receiving such a notification, the processing of the User's Data will be stopped, and his Data will be deleted, except in cases where such processing may be necessary in accordance with the current legislation of Ukraine.

5.3. The functioning of some features of fspro.ua, for which information about the User is required, may be terminated from the moment of Data change/deletion.

5.4. The Company processes and stores Data for the purposes specified in this Policy for the entire period necessary for this, but no longer than 5 (five) years from the date of the User's last interaction with the Site.

6. Data Protection

6.1. When processing Data, the Company applies all necessary technical, organizational, and legal measures to protect Data from illegal and/or unauthorized access to such Data, including from changes, deletion, provision, distribution, as well as other illegal actions.

6.2. The company constantly monitors security measures taken.

7. Additional Terms

7.1. The Company reserves the right to change the terms of this Policy at any time. In this case, the updated version will be posted on the page at the following address: https://fspro.ua/en/privacy-policy. In the event that the User does not agree with the changes, he undertakes to immediately stop any use of the Site.

7.2. "FS PRO" LLC is not responsible for damage or losses suffered by the User or third parties as a result of misunderstanding or misunderstanding of the terms of this Policy.

7.3. In the event that the provisions of this Policy, clauses or their parts, are recognized as contradicting the current legislation of Ukraine, or as invalid, this fact will in no way affect the other provisions of this Policy, they remain fully valid and continue to operate in full and become valid, and any other invalid provision or provision that cannot be fulfilled, without further actions of the Parties, is considered changed, corrected to the extent that it is necessary to ensure its validity and the possibility of fulfillment.

7.4. Terminology used in this Policy has the same meaning as in the User Agreement, unless otherwise specified.
